Appeals Court Agrees to Rehear Case The ninth circuit court of appeals ruled on Tuesday that it would reexamine the legal dispute concerning the president’s authority with an expanded group of 11 judges. The court also overturned a previous decision from a smaller judicial group that had sided with the administration. Legal Saga Over Military Presence This order represents the most recent turn in a long-running court case over whether the administration has the legal right and valid reason to deploy national guard forces in Portland. Approximately two hundred troops have been in limbo since the end of September when the deployment effort was initiated in response to months of protests. Conflicting Arguments The federal government has argued that government employees at the immigration center in south Portland were under attack, while city and state officials assert that local officers have command of the circumstances. Contrary to descriptions of the city as a conflict zone, residents have been sharing footage of scenic paths and a thriving food scene, and planning activities such as an Emergency Naked Bike Ride against the “militarization of our city”. Recent Legal Actions The appeals court decision came after a federal judge in Portland enacted two temporary restraining orders this month – one blocking the federal control of the Oregon national guard, and another prohibiting the use of any military personnel in Oregon, after attempts to evade the initial injunction by calling up troops from California. On Monday, the ninth circuit panel had temporarily suspended the initial decision – allowing command of state troops – but the second ruling remained in place, blocking the actual deployment of the forces. En Banc Review The Tuesday decision means the matter will be heard by the full court – with both rulings under consideration simultaneously – by a panel of 11 judges. “This ruling shows that the truth matters and that the judicial system are striving to hold this administration accountable. The founding document limits the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a official comment. “The court is sending a definite signal: the executive leader cannot dispatch the armed forces into American urban areas without cause. We will continue defending Oregon’s laws, values, and sovereignty as this case moves forward and our fight continues in the courts.”
